PRENUPTIAL AGREEMENTS;
A prenuptial agreement is prepared and executed prior to the parties’ getting married. The agreements are made in part by people who want to protect certain premarital assets and the potential increases in their value from the potential of a divorce. The agreements are also used to provide for a resolution of all other issues pertaining to a divorce such as potential custody; child support; maintenance; disposition of marital property; and all other marital issues which might arise. These agreements, if prepared properly, are usually upheld as being valid and determinative of those issues.
POSTNUPTIAL AGREEMENTS:
A postnuptial agreement is an agreement very much like a prenuptial agreement, but prepared and executed after the parties are married.
SETTLEMENT AGREEMENTS
SOMETIMES REFERRED TO AS STIPULATIONS OF SETTLEMENT:
This type of agreement is entered into by the parties who are about to commence an action for divorce or who have commenced an action for divorce (or separation) in which they agree to establish their own terms of settlement rather than have the court make such determinations.
