No matter how sensitive or complex the issues may be, our main focus is bringing the matter to a swift resolution wherever possible. Some areas of law which may have to be addressed as part of the divorce process include custody of children, child access arrangements (visitation), child support, spousal maintenance, determination of marital and separate property, equitable distribution of assets, pension and other retirement rights, grandparents rights, business evaluations, professional practices, evaluations of degrees and licenses.
The firm works with many well recognized forensic experts in the fields of business, professional practice and other asset valuations including real estate appraisers and psychological and employment experts.
Although the firm has over forty years of trial experience, attempts are made to settle all issues by various methods. Each of the parties knows their lives better than any attorney or judge. Reaching a satisfactory agreement between the parties can be preferable not only for the parties but for their children as well. Certainly where costs and expenses are an issue it is usually less expensive to reach a settlement of all of the issues rather than try the matter before a judge. When a settlement cannot be reached, the firm vigorously represents our clients at trial.
In one such trial this firm succeeded in having both the trial court and the appellate court determine a unique situation. The adverse party had attempted to harm our client’s professional standing as an attorney. As a result of the adverse party’s intentional misconduct, the court awarded our client the more substantial portion of our client’s interest in the practice leaving the adverse party with only a “minimal” percentage of our client’s interest in the law firm. This appears to be the first time such conduct causing the resulting minimal distribution was reported in any case law.
